The process of a personal injury claim typically involves the following stages:
The claimant meets with a personal injury attorney to discuss their case, evaluate its merits, and determine whether they have a valid claim.
The solicitor investigates the claim, gathering evidence such as medical records, accident reports, witness statements, and expert opinions to build a strong case.
The solicitor sends a demand letter to the responsible party or their insurance company, outlining the damages incurred and the compensation sought.
The parties negotiate a settlement, with the attorney advocating for the claimant’s best interests. If an agreement cannot be reached, the case proceeds to litigation.
The solicitor files a lawsuit on behalf of the claimant, formally initiating the litigation process.
Both parties engage in discovery, exchanging relevant information and evidence. This may include depositions, interrogatories, and document requests.
The parties may file pre-trial motions to resolve certain legal issues, such as the admissibility of evidence or dismissal of the case.
The parties may participate in mediation or a settlement conference, attempting to resolve the case before trial.
If the case is not settled, it proceeds to trial. The claimant’s attorney presents their case before a judge or jury, who then determines liability and awards damages, if applicable.
After the trial, either party may appeal the verdict. If no appeal is filed or if the appeal is unsuccessful, the awarded damages are paid to the claimant.
Once the case is resolved and the claimant receives compensation, the personal injury claim process comes to an end.
